TERMS & CONDITIONS OF SALE

1. PAYMENT TERMS

  • Deposit: A 50% non-refundable deposit is required to confirm all orders and initiate production. This deposit secures raw materials, production scheduling, and block selection.

  • Balance: The remaining 50% is due immediately upon completion and prior to shipment. Completion is evidenced through professional photographic documentation provided by Arthur Vallin LLC.

  • Final Approval: Written approval of these photographs constitutes full and binding acceptance of the piece. Once approved, no further modifications, returns, or refunds will be granted.

  • All Sales Final: Due to the bespoke, made-to-order nature of the work, all sales are final after photographic approval, regardless of subsequent client preferences or environmental changes affecting the piece.

2. MATERIAL CHARACTERISTICS & DISCLAIMERS

  • Stone: Each work is crafted from natural stone, which may feature veining, tonal variation, fissures, inclusions, or crystalline patterns that are not visible prior to carving. These are intrinsic to the medium and not considered defects or grounds for claim or return.

  • Wood: Solid wood is a living material. It reacts naturally to environmental conditions, including humidity, temperature, and light exposure. This may lead to subtle movement, checking, or minor visual shifts at joints or seams over time. These characteristics are not defects and are expected in high-quality artisanal work.

  • Disclaimer: Arthur Vallin LLC expressly disclaims liability for material changes that arise from natural aging or environmental conditions, including—but not limited to—joint movement, warping, discoloration, or visible seams.

3. TRANSPORT, PACKAGING & STORAGE

  • Shipping: If arranged by Arthur Vallin LLC, shipments are professionally packed and insured. Clients must sign delivery receipts “with reserve” to activate any damage-related insurance claim. Failure to do so voids all shipping-related liability.

  • Customs & Duties: All customs duties, import taxes, and related fees are the responsibility of the buyer unless otherwise specified in writing.

  • Packaging Responsibility: Crating ensures maximum protection during transit. Clients are responsible for safe handling and unpacking upon delivery. Arthur Vallin LLC is not liable for damage incurred post-delivery or during client-arranged transport.

  • Storage: Complimentary storage is provided for 14 calendar days after client notification that a piece is ready. Thereafter, a storage fee of $3.50 per cubic meter per day applies and must be settled before release.

4. PRODUCTION & DELIVERY TIMELINE

  • All timelines are good faith estimates and subject to material availability, third-party delays, and force majeure events. Delays, whether in production, shipping, or customs, do not constitute grounds for cancellation, refund, or compensation.

5. CLAIMS & WARRANTY

  • No Warranty: Due to the bespoke, collectible nature of each piece, Arthur Vallin LLC offers no warranty of any kind, whether express or implied. This includes but is not limited to warranties of merchantability, fitness for a particular purpose, or durability over time. Natural materials such as stone and wood will continue to evolve based on their environment; these changes are not considered defects.

  • Claims Process:

    • Clients must inspect the piece immediately upon delivery. Any claim for clear, structural damage in transit must be submitted in writing within 3 calendar days of receipt, accompanied by detailed, time-stamped photographs of both the packaging and the product.

    • Claims submitted after this period, or without proper documentation, will not be accepted.

    • Once the piece has been unpacked, installed, or handled by third parties, Arthur Vallin LLC assumes no responsibility for any damage, defect, or dissatisfaction.

  • Remedy (if applicable): In rare, validated cases of significant damage during transport (and only if shipping was arranged by Arthur Vallin LLC), resolution will be determined solely at the discretion of Arthur Vallin LLC. Clients may be required to return the piece in original packaging at their own expense. No other remedy or compensation will be offered.

6. LIMITATION OF LIABILITY

  • To the fullest extent permitted by law, Arthur Vallin LLC disclaims all liability for indirect, incidental, special, or consequential damages including, but not limited to: loss of revenue, resale value, business interruption, or reputation.

  • The client understands and accepts that collectible, handmade furniture involves inherent variation and unpredictability. These are not only expected—they are integral to the object’s uniqueness and authenticity.

7. GOVERNING LAW & JURISDICTION

  • These terms are governed by and construed in accordance with the laws of the State of Connecticut, United States. All disputes shall be subject to the exclusive jurisdiction of the courts located within Connecticut.
